My friend just bought a car and was ripped off. Need advice, please read…?

One month ago, my friend took out a loan through a dealership and bought a 2006 automobile. Just today we found out that the car was in a wreck because the headlight went out, and the wiring is all screwed up, and taped together. The mechanic that told us that also told us that the driver’s door rattles when it is shut because there is no "safety bar" in it. He said if she was ever t-boned, it would not be excellent. What is the dealership obligated to do. Must they fix it for free, and if they refuse does she have a winnable lawsuit? We live in New York. Any professional advice, or similar experiences are greatly appreciated.

Contact the County/States Attorney for further advise. Have dealer bring up previous history with a Car Fax report which should of been done before the car was resold or http://www.carfax.com

Did she get a Carfax report done prior to purchasing the car?
Did she check the service history out at all?
your friend should have done a carfax report as it may have showed up on that.
He should go to the dealer with a statement from the other shop detailing the problems with the car…if they will not agree to take back the car he should hire an attorney to write a strong letter asking for his money or thay will pursue a criminal complaint for fraud…that should get the dealers attention.
A 2006 vehicle should still be under warranty. If the vehicle was totaled out you should have been able to find out prior to the buy being made. If it was only hurt and subsequently repaired (even if poorly) I reckon you are out of luck. A warranty will not cover defects due to accident hurt. I recommend talking to the dealer and see what they may be willing to do. I don’t believe they are obligated to do anything.
